TRUMP OPENS THE HIGHWAY TO TAX-FREE RED DIESEL! | Monday’s order defers the federal tax on off-road dyed diesel through Dec. 31 and calls off IRS penalties — but “deferred” isn’t “forgiven,” and the states still hold their own cards

TRUMP OPENS THE HIGHWAY TO TAX-FREE RED DIESEL!

The red stuff is coming out of the barn. President Donald Trump signed an executive order Monday night to temporarily allow off-road “dyed” diesel for highway use and defer the federal excise tax on it, according to the White House fact sheet.

Trump unveiled it at a rally in Nebraska, NBC News reports: “Tonight I’m going to sign a historic executive order to officially waive the off-road requirement and allow anyone to purchase tax-free red dye diesel for any reason.” The White House claims it will save truckers over $100 per refill.

The fine print, straight from the order itself: within five days, Treasury must decide whether relief is authorized under a federal tax-deadline relief statute (26 U.S.C. 7508A) and, if so, defer the tax on dyed diesel used on the road from Oct. 5 through Dec. 31, 2026 — without penalties or interest — and have the IRS announce it won’t impose dyed-fuel penalties for that period. Treasury is told only to “explore avenues, including legislation,” to wipe out the deferred bill. States get a nudge, not a mandate: the White House will “encourage” them to adopt matching policies.

Why now? Pain at the pump. NBC says diesel hit an all-time high of $6.52 a gallon on Sept. 22, per AAA, and is up more than 70% since the Iran war began Feb. 28 — with Ukrainian drone strikes on Russian refineries pushing the Kremlin to ban diesel exports. Voters in both parties are citing gas prices and the cost of living as top midterm issues.

Wall Street noticed: CNBC says stock futures rose Tuesday morning as Treasury yields and oil prices both dropped. Farmers, truckers and anybody with a diesel tank: watch for that Treasury guidance — and your state’s rules — before you fill up red.
